Misuse of Drugs Act 1975 · 2026
The law, row by row
Christchurch follows New Zealand's Misuse of Drugs Act. Cannabis is illegal, but since 2019 police must consider whether a health approach would be better than charging someone for personal possession.
| What you do | What the law says | Maximum |
|---|---|---|
| Carry or use a small amount | Illegal. Police often give a warning or a referral to health support. | 3 months / $500 |
| Own a pipe, a bong or seeds | A separate offence. | 1 year / $500 |
| Carry 28 g or more, or 100 joints | Presumed supply: you must prove you are not dealing. | 8 years |
| Share with an adult | Supply, punished like possession. | 3 months / $500 |
| Give to anyone under 18 | Dealing, even for free. | 8 years |
| Sell, or offer to sell | Dealing, whatever the amount. | 8 years |
| Grow, even one plant | Cultivation. | 7 years |
| Drive after using | Random saliva tests. Driving while impaired is a criminal offence. | 12 h ban + fine |
| Use medicinal cannabis on prescription | Legal, CBD included, under the Medicinal Cannabis Scheme. | – |
No coffee shops, no clubs, no legal market: in New Zealand there is no legal way to buy cannabis for recreational use.
Roadside saliva tests across Canterbury
Since July 2026, police test drivers at random everywhere in New Zealand, from the city to the Canterbury highways. No suspicion is needed.
- Two positive saliva tests: no driving for 12 hours.
- Lab confirmed: $200 and 50 demerit points, or $400 and 75 points for two or more drugs.
- Refusing the test: $400, 75 demerit points and a 12-hour ban.

Help in Christchurch
- Never drive after using: saliva tests detect recent use.
- Stay away from synthetic cannabinoids ("synnies"): they have caused many deaths in New Zealand.
- Avoid mixing with alcohol, and go slow with edibles.
- Never around minors, and never pass it on.
